Part B — Appliance Rentals
15. Nature of the Agreement
15.1 Easy Rentals Group rents fridges, bar fridges, microwaves and combination packages ("Appliances") for domestic use.
15.2 This is a rental agreement only. The Appliance remains the property of Easy Rentals Group at all times. No ownership of the Appliance, and no right or option to buy it, passes to you, regardless of how much rental you pay. Rental payments are payments for the use of the Appliance, and not towards its price.
15.3 You may not sell, lend, sub-let, pledge or otherwise dispose of or encumber the Appliance, or remove, alter or cover its Easy Rentals Group asset label.
16. Rental Period and Charges
16.1 The rental period is 12 months from the delivery date. Rental is charged for 10 months of the rental period; no rental is charged for December and January. The no-charge period forms part of the pricing of the full rental period.
16.2 The following charges apply, as set out in our current price list for the Appliance and grade selected:
Charge | When payable | Refundable? |
|---|---|---|
Activation fee | Before delivery | No |
Monthly rental | On or before the 1st day of each charged month | No |
Late payment administration fee | If rental is not received by the [26th] day of the month | No — [R50.00] per month |
16.3 Appliances are offered in Grades A, B and C, which reflect their age and cosmetic condition. All grades are tested and in good working order at delivery.
16.4 The rental is fixed for the 12-month rental period. Price changes apply only to new agreements and renewals.
17. Delivery and Inspection
17.1 Once your application is approved and the deposit and activation fee are paid, we will schedule delivery. Delivery is normally completed within 3 business days, but may take longer during peak periods.
17.2 The Appliance is delivered only to the address in your application. You, or a person you authorise in writing, must be present at delivery.
17.3 At delivery, you and our staff member will inspect the Appliance and sign a delivery inspection form recording its condition, grade, asset number and accessories, and you will sign the Appliance Rental Agreement. The signed delivery inspection form is the agreed record of the Appliance's condition at delivery.
18. Use and Care
18.1 You must use the Appliance only for normal domestic purposes and in accordance with the manufacturer's instructions; keep it clean, and defrost fridges when required; protect it from damage, misuse, fire, water and theft; and allow us to inspect it on reasonable notice.
18.2 You must keep the Appliance at the delivery address. If you move, you must notify us in advance, and we will arrange the relocation.
18.3 You must not open, repair, modify or tamper with the Appliance, or allow anyone other than Easy Rentals Group to do so. You are responsible for the cost of electricity used by the Appliance.
19. Faults and Maintenance
19.1 You must report any fault through the Portal or by WhatsApp within [24] hours of becoming aware of it, and stop using the Appliance if continued use could cause further damage.
19.2 Where a fault results from fair wear and tear or a defect, we will repair or replace the Appliance at our cost within [3] business days of your report. If the Appliance cannot be used for more than [5] consecutive business days for a reason that is not your responsibility, we will provide a substitute appliance
19.3 Where a fault results from misuse, negligence or tampering, you are liable for the reasonable cost of repair or replacement under clause 20.
20. Loss, Theft and Damage
20.1 You are responsible for the Appliance from delivery until it is collected by us, and are liable for any loss, theft of or serious damage to the Appliance during that period, other than fair wear and tear or manufacturer defect.
20.2 If the Appliance is stolen, you must report the theft to the South African Police Service within 24 hours, and provide us with the case number within [48] hours.
20.3 Where the Appliance is lost, stolen or damaged beyond economical repair, you are liable for its replacement value:
20.4 Where the Appliance is damaged but repairable, you are liable for the reasonable cost of repair, supported by a quotation or invoice. Easy Rentals Group does not insure the Appliance on your behalf.
21. Non-Payment and Recovery
21.1 If rental remains unpaid for [30] days after the due date, we will give you written notice requiring payment within 20 business days. If payment is not made, we may cancel the agreement, and the amounts in clause 22.2 become payable.
21.2 We will only collect an Appliance with your consent, or under an order of court. Our staff will not enter your room or premises without your permission.
21.3 Overdue amounts may be handed over to our attorneys for recovery, and you will be liable for the reasonable legal and collection costs incurred, to the extent permitted by law.
22. Cancellation and End of the Rental Period
22.1 After the cooling-off period, you may cancel the agreement by giving 20 business days' written notice, in accordance with section 14 of the CPA.
22.2 On cancellation before the end of the rental period, whether by you or by us for breach, you are liable for:
22.2.1 all rental due up to the end of the 20-business-day notice period;
22.2.2 a cancellation fee equal to [one month's rental], or the total rental remaining, whichever is less;
22.2.3 the collection fee of R250;
22.2.4 where the December and January no-charge period has already been used, [one month's rental for each no-charge month used]; and
22.2.5 the reasonable cost of repairing any damage beyond fair wear and tear.
22.3 Between 40 and 80 business days before the rental period ends, we will notify you of the end date and your options to renew or return the Appliance. If you do not respond, the agreement continues month-to-month at the current rental, and either party may cancel on 20 business days' written notice.
22.4 On return, the Appliance must be clean, empty and defrosted, and you or your representative must be present to sign the collection inspection form. Your deposit is refunded within [7] business days after collection and inspection, less any amounts owing.
Part C — Holiday Storage
23. The Storage Service
23.1 Easy Rentals Group collects, stores and returns Customers' belongings during the holiday period.
23.2 The storage period is selected by the Customer, for between 1 and 5 months, between October and March, and is stated in the Customer's quotation.
24. Prohibited Items
24.1 The Customer may not submit the following for storage:
24.1.1 flammable, explosive, corrosive or hazardous materials, including gas cylinders, fuel, paint and aerosols;
24.1.2 illegal goods, stolen property, firearms, ammunition, weapons or controlled substances;
24.1.3 food, beverages, liquids, plants or perishable items;
24.1.4 live animals or any biological material;
24.1.5 cash, jewellery, precious metals, identity documents, passports or bank cards; and
24.1.6 items of irreplaceable, sentimental or exceptional monetary value.
24.2 We may refuse to collect, or may return at the Customer's cost, any item we reasonably believe is prohibited. The Customer is solely responsible for any loss, damage, injury or claim arising from a prohibited item stored in breach of this clause.
25. Declaration and Quotation
25.1 The quotation is based on the items, storage period and services declared by the Customer, who warrants that the declaration is complete and accurate.
25.2 If the items presented at collection or drop-off differ materially from the declaration, we will issue a revised quotation before the items are accepted into storage. If the Customer does not accept it, we may decline to store the undeclared items.
26. Collection, Condition and Packing
26.1 All items must be legally owned or possessed by the Customer, clean, dry, free of pests, and securely packed for transport and storage.
26.2 At collection or drop-off, we will record the condition and quantity of the items on an inspection form, supported by photographs. The Customer, or a representative they authorise in writing, must sign the form. The signed inspection form is the agreed record of the items' condition and quantity.
27. Limitation of Liability
27.1 Easy Rentals Group's total liability for loss of, or damage to, stored items due to natural disaster or events and is limited to R5000 per storage booking (subjective), unless the loss or damage results from our gross negligence.
27.2 Easy Rentals Group is not liable for:
27.2.1 damage caused by inadequate packing;
27.2.2 gradual deterioration, mould or pest damage to items that were not clean and dry when submitted; or
27.2.3 the loss of, or damage to, any prohibited item.
27.3 The Customer is advised to insure items of significant value.
28. Payment and Return
28.1 Payment of [the full storage fee] is required before the collection or drop-off date is confirmed.
28.2 The Customer must book a return date through the Portal at least [7] days before the storage period ends, and pay the return delivery fee before the return date is confirmed.
28.3 On return, the Customer or their authorised representative must sign the delivery sheet confirming receipt of the items.
29. Cancellation, Early Retrieval and Storage Credit
29.1 Storage credit instead of cash refund. Storage capacity, collection slots and staff are reserved for each Customer for the full storage period, and cannot readily be re-allocated during the holiday season. Accordingly, after the cooling-off period, storage fees are not refunded in cash. The unused amount is instead issued as a storage credit ("Storage Credit"):
29.1.1 where the Customer cancels before the items are collected or dropped off, the full storage fees paid are issued as Storage Credit; and
29.1.2 where the Customer retrieves the items before the end of the storage period, the storage fees for each full month remaining after the retrieval date are issued as Storage Credit.
29.2 Storage Credit may be used towards any future Easy Rentals Group Holiday Storage booking. It is valid for 3 years from the date of issue, or until fully used, in accordance with section 63 of the CPA. It is recorded on the Customer's Portal account, is not exchangeable for cash, and may not be transferred without our written consent. Collection and delivery fees for services already performed are not included.
29.3 Early retrieval. The Customer may retrieve items early by giving at least [5] business days' written notice and paying the return delivery fee in advance.
29.4 Failed collection. If our team arrives on the agreed date and the items are not available, or the Customer or their representative is not present, a failed collection fee of R250 is payable for each rescheduled attempt.
29.5 Declined items. If we decline to store items under clause 24 or 25, the agreement is cancelled for those items. Collection costs already incurred are retained, and the balance is refunded.
30. Uncollected Items
30.1 If items are not retrieved by the end of the storage period, additional storage charges of [the monthly quoted amount] apply until the items are retrieved.
30.2 Easy Rentals Group holds a lien over the stored items for all amounts owing.
30.3 If items remain uncollected, or amounts remain unpaid, for [30] days after the end of the storage period, we will give the Customer written notice, by email and WhatsApp, requiring collection and payment within a further [30] days.
30.4 If the Customer fails to comply with that notice, we may sell or otherwise dispose of the items, in accordance with the Storage Agreement, to recover the amounts owing. Any balance of the proceeds, after deducting amounts owing and reasonable costs of sale, will be paid to the Customer.
Part D — Student Accommodation
31. The Property and Rooms
31.1 Part D is entered into in accordance with the Rental Housing Act 50 of 1999 ("the Rental Housing Act") and its Unfair Practice Regulations. The Property is situated at 20 Steven Street, Park West, Bloemfontein, Free State, and is owned by Easy Rentals Group ("the Landlord").
31.2 The following room types are available:
Room type | Description | Breakage deposit |
|---|---|---|

32. Lease Period
32.1 The lease runs for 10 months, from [1 February] to [30 November] of the academic year, and ends automatically on the last day. The Tenant must vacate by [12:00] on that day, unless a renewal has been agreed in writing.
32.2 We will notify the Tenant of the option to renew between 40 and 80 business days before the lease ends.
33. Rent and NSFAS Funding
33.1 The monthly rent is:
Room type | NSFAS-funded Tenants | Self-funded Tenants |
|---|---|---|
Ensuite room | NSFAS-approved rate for the academic year | Available upon request |
Single room | NSFAS-approved rate for the academic year | Available upon request |
Sharing room | NSFAS-approved rate for the academic year | Available upon request |
33.2 Rent includes water, electricity, Wi-Fi and the use of the furnished room and common areas, and is fixed for the lease period.
33.3 Self-funded Tenants pay rent monthly in advance, on or before the 1st day of each month.
33.4 NSFAS-funded Tenants:
33.4.1 rent is charged at the NSFAS-approved rate and paid by NSFAS directly to the Landlord;
33.4.2 the Tenant must complete all steps NSFAS requires for the accommodation allocation and payment, including signing any NSFAS lease or confirmation, within [7] days of being asked;
33.4.3 we will not treat a delay in NSFAS payment as a breach by the Tenant, provided the Tenant has complied with clause 33.4.2; and
33.4.4 if NSFAS accommodation funding is declined, withdrawn or reduced, the Tenant must notify us within [7] days. From the end of the month in which the funding ends, the Tenant is responsible for rent at the self-funded rate, or may cancel under clause 38.
34. Breakage Deposit
34.1 The Tenant must pay the breakage deposit for their room type before moving in.
34.2 At the end of the lease, the deposit may be used to cover unpaid rent; the reasonable cost of repairing damage beyond fair wear and tear caused by the tenant or their visitors; replacing lost keys, remotes or access cards; and cleaning, where the room is not left in the required condition. The deposit may not be used as payment of the final month's rent.
34.3 The deposit is refunded:
34.3.1 if no amounts are owing, within 7 days after the lease ends;
34.3.2 if amounts are owing, within 14 days after the room has been restored, with receipts or proof of the costs deducted; and
34.3.3 if the Tenant does not attend the outgoing inspection, within 21 days after the lease ends.
35. Move-In and Utilities
35.1 Before move-in, the Tenant and the Landlord will jointly inspect the room and sign the Room Inventory (Schedule B). The Tenant may move in once the signed Lease Agreement and deposit, and for self-funded Tenants the first month's rent, have been received.
35.2 Utilities are included on a fair-use basis. The Tenant may not use electric blankets, or other high-consumption appliances in their room without our written consent.
35.3 We are not liable for interruptions to utilities caused by load-shedding, municipal outages or service provider failures beyond our control.
36. Obligations and Access
36.1 The Tenant must use the room only as their private residence; not sub-let it or share it with an unauthorised person; keep the room and furniture clean and in good condition; comply with the House Rules and ensure their visitors do so; report damage or faults promptly; make no alterations without our written consent; and keep no pets.
36.2 The Tenant is responsible for damage beyond fair wear and tear caused by them or their visitors. Personal belongings are kept at the Tenant's own risk.
36.3 The Landlord will maintain the Property, furniture and common areas in good, safe and habitable condition.
36.4 The Tenant is entitled to privacy. We will enter the Tenant's room only at a reasonable time after at least [24] hours' notice, or without notice in an emergency threatening life, safety or the Property.
37. Breach and Termination
37.1 Breaches of the House Rules are dealt with progressively: a written warning for a first breach, a final written warning for a second breach, and treatment as a material breach for any further breach. A serious breach listed in Schedule A may result in a final written warning on the first occurrence.
37.2 If the Tenant materially breaches the lease, we will give written notice requiring the breach to be remedied within 20 business days. If it is not remedied, we may cancel the lease.
38. Cancellation and Move-Out
38.1 Before move-in. If the Tenant cancels after approval and payment of the deposit:
38.1.1 at least [30] days before move-in, an administration fee of 50% of the amount paid is retained and the balance is refunded; or
38.1.2 less than [30] days before move-in, a cancellation fee of [one month's rent], or the rent until the room is re-let, whichever is less, is retained.
38.2 After move-in. The Tenant may cancel on 20 business days' written notice, and is liable for rent to the end of the notice period or the date of vacating, whichever is later, and a cancellation fee of [one month's rent], or the rent until the room is re-let, whichever is less. Amounts recovered from a new Tenant for the same period reduce this amount.
38.3 Move-out. The room is jointly inspected within the 3 days before the Tenant vacates. The Tenant must leave the room clean and in the condition recorded at move-in, fair wear and tear excepted, empty and clean the fridge, and return all keys, remotes and access cards.
38.4 Belongings left behind will be listed and the Tenant notified in writing. If they are not collected within [30] days of that notice, we may dispose of them, and the reasonable cost of removal may be deducted from the deposit.
39. Accommodation Disputes
39.1 Either party may refer an unresolved accommodation dispute to the Free State Rental Housing Tribunal, which resolves disputes between landlords and tenants free of charge.
Part E — Refunds and Fees
40. Refunds and Discretionary Relief
40.1 All cancellation fees in these Terms are intended to be reasonable, reflecting the actual costs and losses Easy Rentals Group incurs when an agreement ends early.
40.2 Refunds are paid only by EFT into a bank account in the name of the Customer, or of the person who made the payment, on receipt of proof of the account. Card payments made through PayFast are refunded to the original card. We do not pay refunds in cash, or into a third party's account without the Customer's written authority.
40.3 Unless these Terms or the law require a different period, refunds are paid within [10] business days after the amount due has been finalised. Every refund is accompanied by a statement of the amounts paid, any deductions and the reasons for them.
40.4 Amounts owing by the Customer may be set off against any refund, deposit or credit held by Easy Rentals Group.
40.5 Where a Customer must cancel because of circumstances beyond their control, such as deregistration from their institution or the death of a family member, we may, on written supporting proof, reduce or waive a cancellation fee. This relief is granted at our discretion, case by case, and creates no precedent for any other Customer.
